Certified.” was not false advertising that harmed a rival’s business, despite the fact that some members had not yet completed training, the Tenth Circuit ruled in an advisory released Tuesday.

In a 13-page opinion, a three-judge panel upheld a Colorado federal judge’s decision to grant summary judgment to the American Society of Home Inspectors, which had been sued by competitor International Association of Certified Home Inspectors, or InterNACHI, for allegations that the ASHI’s slogan “American Society of Home Inspectors. Educated. Tested. Verified. Certified” was misleading advertising because the group promoted “novice” inspectors…
