Jason Roberts ‘absent’ in shooting of police officers Gary Silk and Rodney Miller

Mr Hallowes said witnesses who are police officers have lied before under oath and the jury will hear repeated lies in evidence.

“We are saying that some officers in the investigation were at fault,” he said.

Prosecutor Ben Ihle, QC, told the trial that forensic experts believed 11 shots were fired from three guns: Seven bullets from two guns were fired at the officers, while the constable Principal Miller had fired four times. Sergeant Silk’s gun was still holstered and had not fired when he was found dead, Mr Ihle said.

In his opening speech, Mr Ihle said he expected the evidence to show that Mr Roberts shot Sergeant Silk and Debs shot the two officers.

He also said the prosecution would call Debs, who is expected to say Mr Roberts “was indeed with him the night Gary Silk and Rodney Miller were murdered”.

Mr Hallowes called the prosecution’s decision to call Debs “an act of desperation”.

Prosecutors say the two men were prepared to use their weapons to avoid capture and are criminally responsible for the officers’ deaths because they helped each other and the shots were fired with murderous intent.

The trial heard that when Senior Constable Miller’s co-workers found him seriously injured, he made reference to two gunmen. Those references, Mr. Ihle said, included the comments “Two, one on foot” and “Grab ’em, I’m screwed.”

Senior Constable Miller died in hospital a few hours later.

The registered owner of the Hyundai was Debs’ daughter, Nicole. She was Mr. Roberts’ girlfriend at the time.

Mr Ihle told the jury that Mr Roberts’ admission to the armed robberies established pattern evidence that showed he was with Debs at Moorabbin.
