New Jersey High Court skeptical of Union Carbide asbestos verdict

By Bill Wichert (January 19, 2022, 8:32 PM EST) — The New Jersey Supreme Court on Wednesday cast doubt on a widow’s attempt to restore a $2.38 million verdict against the Dow Chemical Union unit Carbide, the judges are examining whether manufacturers could fulfill their obligation to warn workers of the dangers of asbestos through information provided to employers.

This issue is at the center of Thomasenia Fowler’s challenge to a state appeal ruling last year granting a new trial to Houston-based Union Carbide for the death of her husband from mesothelioma on the grounds that the jurors were given improper instructions, including the company’s duty to warn could not be satisfied by the materials given…
