BOCA RATON, Florida., March 7, 2022 /PRNewswire/ — Shiner Law Group Attorneys David I. Shiner and Joseph A. Mendelsohn filed a lawsuit against the national chain store, CVS Pharmacy, Inc. as well as the pharmacist, Linda Trang Nguyenfollowing an incident that occurred on November 24, 2021in a CVS pharmacy located at Broward County, Florida.
The incident occurred after the plaintiff, Ms. Meltzer, visited a CVS pharmacy located in Coconut Creek, Florida, and asked CVS and its pharmacist to administer an annual flu shot. Instead of injecting the applicant, who has consented to the influenza vaccine, the CVS pharmacist on duty, Linda Trang Nguyen, instead injected the plaintiff with the Pfizer COVID-19 vaccine. It is important to note that the applicant never requested or consented to the injection of the COVID-19 vaccine. “Regardless of anyone’s position on vaccination itself, I think everyone would agree that it is deeply wrong – and potentially deadly – for a pharmacist to inject anything into a person without their consent or knowledge of that person,” Mr. Shiner said. “We believe it is important to draw public attention to these types of issues, namely the negligent dispensing of drugs by a pharmacy.”
Importantly, Mr. Shiner also said that “our investigation to date has revealed that this is not the first time that CVS has injected someone with the COVID-19 vaccine without the person’s prior consent.” . He continued, “I’m very disturbed that CVS hasn’t taken appropriate steps to ensure this doesn’t continue to happen to people.” According to recent reports, CVS has also been sued in other states when CVS pharmacists injected underage children with adult doses of the COVID-19 vaccine instead of the annual childhood flu shots.
According to attorney Mendelsohn, he is of the opinion that “a jury will understand that regardless of their personal position on this particular vaccine, a pharmacy has a duty to its customers to safely and competently dispense any type of drug, and no one should be subjected to an injection of any type of medication without their specific consent.” Mr. Mendelsohn further stated that he has handled other similar types of cases with Shiner Law Group where pharmacists have improperly provided over-the-counter medications to people and, unfortunately, those other cases that the firm handles have resulted in serious injury and even death.
